1. Acceptance of Terms
By accessing or using Xylos ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all users, including traders, merchants, and visitors.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform. By using Xylos, you represent and warrant that you meet this requirement and are not prohibited from using derivative trading services under your local laws.
3. Account Registration
You are responsible for maintaining the security of your account credentials, including your password and any two-factor authentication methods. You agree to notify Xylos immediately of any unauthorized access. You may not share, sell, or transfer your account to another person.
4. Trading & Leverage
Xylos provides leveraged derivative trading up to 5000x on certain instruments. Leveraged trading carries a high degree of risk and is not suitable for all investors. You may lose more than your initial deposit. Past performance is not indicative of future results. You are solely responsible for all trading decisions.
5. Prop Fund Challenges
Prop fund challenge entry fees are non-refundable. Funded accounts are subject to drawdown limits and profit-sharing rules as described at the time of enrollment. Xylos reserves the right to modify challenge parameters for future enrollments. Payouts from funded accounts are subject to verification.
6. Merchant Marketplace
Merchants who list assets on the Xylos Marketplace are responsible for the accuracy of their listings, price feeds, and market resolution. Xylos is not liable for losses resulting from merchant-operated markets. Listing fees and revenue share percentages are as described at the time of listing.
7. Referral Program
Referral commissions are earned on trading fees generated by referred users. Xylos reserves the right to modify commission rates, bonus amounts, and program terms. Self-referrals, fake accounts, or any form of abuse will result in forfeiture of referral earnings and potential account termination.
8. Deposits & Withdrawals
All deposits and withdrawals are processed in USDT. On-chain transactions are subject to network fees and confirmation times. Fiat on-ramp services are provided by third-party payment processors and subject to their own terms. Xylos is not responsible for delays caused by blockchain congestion or third-party processors.
9. Prohibited Activities
You may not: (a) use the Platform for money laundering or terrorist financing; (b) manipulate markets through wash trading, spoofing, or layering; (c) exploit bugs or vulnerabilities; (d) use bots or scripts except through the officially provided API; (e) impersonate other users or Xylos staff; (f) access the Platform from sanctioned jurisdictions.
10. Risk Disclaimer
Trading derivatives involves substantial risk of loss. The high degree of leverage can work against you as well as for you. You should carefully consider whether derivative trading is appropriate for you in light of your financial situation. Xylos does not provide financial, investment, or tax advice.
11. Limitation of Liability
Xylos shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of profits, trading losses, or data loss. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
12. Modifications
Xylos reserves the right to modify these terms at any time. Material changes will be communicated via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the modified terms.
